During the Bush administration, the number of federal obscenity prosecutions skyrocketed. Aside from the obvious moral duty to uphold the law, it's also an issue of fine government. The question is how do we stability the benevolent consequences of those laws against the terrible effect of restricting free speech? The Millian mind-set is a technique to try this. Rather than simply regulating the commercial industry of pornography, we want to accept as true with the broader societal impact of this activity. Moreover, users of excessive pornography need to take responsibility for the market they create. There are a myriad of arguments to be made during this debate. For starters, who will be punished? Given the range of pornographers out there, that's a large number of finding out to be done. Besides, it's hard to choose one person to judge for the whole. Other awsome-sounding laws that have been enacted include the Criminal Justice and Immigration Act, which bans depictions of necrophilia, severe bodily harm, and other sexually oriented acts. Another example is the Protection of Children Act, which comprises provisions that prohibit depictions of bestiality and sexual acts that would somewhat be considered obscene. While these laws may appear like a tyrannical effort to restrict free expression, they're a necessary evil.
