In order to be effective, the statute must be able to live on the scrutiny of the courts. This means that it has to be narrowly tailored, but not too narrowly adapted. While the text of COPA is quite corresponding to the Communications Decency Act (CDA), the two statutes differ in a number of key ways. For instance, the language of the CDA is much more broad. It defines "dangerous fabric" as "articles, recordings, or other communications" that may be harmful to infants. But while the CDA didn't define the actual parties guilty for violating the law, COPA does. Any person who "knowingly and with abilities" makes a advertisement communication will be liable under the statute. A variety of civil liberties groups filed a lawsuit towards COPA, arguing that it violated their First Amendment rights. An injunction was issued by a federal district court in Philadelphia. That injunction was upheld by the Third Circuit Court of Appeals in June 2000. Although the lower court choice was upheld, the appeals court found that the statute was too broad.
